During 2024, TESPA embarked on three important initiatives related to groundwater protection in the Wimberley Valley. Aqua, a public water utility serving portions of the Wimberley area, got into a dispute with the Hays Trinity Groundwater Protection District over penalties for over pumping and sued the District in Federal Court, arguing among other things that the District lacked authority to regulate the utility's over pumping beyond permit limits. This action by Aqua, if allowed by the courts, would totally undermine the ability of our groundwater district and districts in Texas to protect groundwater resources. As protection of groundwater resources was a basis for creating TESPA, the board of directors voted to intervene in the federal action and pursue an administrative action at the Public Utility Commission of Texas seeking their assistance in forcing Aqua to obey Texas law. TESPA's intervention was successful in obtaining the relief we were seeking, and we have now withdrawn to amicus curie status while we pursue the in October. On another front, TESPA is closely monitoring a stone quarry/mining proposal that threatens to contaminate the aquifer with explosions used to loosen the rock. To date, a notice of intent to sue has been filed and the quarry activity has not used explosives to date. If they proceed without using explosives, it will be a win for TESPA and for the mining company as well.
