MEHs primary focus at inception was on qualifying a measure for the ballot on whether or not the city of Livermore would allow 130 housing units to be built downtown. The committee cited the projects violations of the California Environmental Quality Act as a reason for public input on the project. When the city denied outright the committees request for a referendum, the committee sued the city and its election commission. The vote on the measure has been involved in court proceedings as part of its program activities to convince the decision-makers that the voters have the right to vote on the measure. The first proceeding ended in dismissal of the case in the Citys favor. MEH appealed that decision and continued to advocate for the rights of the public citizenry of Livermore to decide the merits of the housing proposal and the ultimate use to which the proposed development site should be made. In January 2023 First District Court of Appeal and Alameda County Superior Court ruled in favor of the low income housing project effectively negating the purpose of the committee. Instead of having the opportunity to educate the public on the reasons not to build a potentially large and unsafe project, the committee was forced to spend its energies and resources on litigation. The committee continues to meet its related financial commitments.
