THE PRIMARY EXEMPT PURPOSE OF PARADISE MEMORIAL PARK CEMETERY MEMORIAL FUND (THE FUND) IS TO PROVIDE FOR THE MAINTENANCE, CARE, IMPROVEMENT AND EMBELLISHMENT OF PARADISE MEMORIAL PARK CEMETERY (CEMETERY). THE FUND WILL ALSO ASSIST FAMILY MEMBERS IN LOCATING THE REMAINS OF RELATIVES BURIED AT THE CEMETERY.THE CEMETERY WAS ACQUIRED BY THE FUND AS RESULT OF A LEGAL SETTLEMENT BETWEEN THE FORMER OWNERS OF THE CEMETERY AND VARIOUS INTERESTED PARTIES. THE SUPERIOR COURT OF THE COUNTY OF LOS ANGELES AND THE CALIFORNIA DEPARTMENT OF CONSUMER AFFAIRS APPROVED THE TRANSFER TO THE FUND AS PART OF THE LEGAL SETTLEMENT.THE LEGAL SETTLEMENT ALSO PROVIDED AN INITIAL CAPITAL CONTRIBUTION TO THE FUND FROM THE PROCEEDS OF THE LITIGATION. THE MAIN PURPOSE OF THE CAPITAL CONTRIBUTION IS TO PROVIDE A PERMANENT ENDOWMENT TYPE RESERVE FOR THE FUND TO FINANCE THE REASONABLE AND NECESSARY MAINTENANCE OF THE CEMETERY FOR DECADES TO COME.THE COURT ORDER APPROVING THE LEGAL SETTLEMENT AND THE GOVERNING INSTRUMENTS OF THE FUND CONTAIN PROVISIONS THAT LIMIT THE SPENDING OF THE NON-PROFIT, AND REQUIRE THAT THE FUNDS BE HELD BY AN INSTITUTIONAL TRUSTEE AT A FEDERALLY INSURED FINANCIAL INSTITUTION.
